Terms of Use

1. Scope

These Terms of Use govern the use of the Sportscar Tours app (the “App”) between you and Stefan Zechmeister (the “Provider”). By downloading or using the App, you agree to these terms. If you do not agree to them, please do not use the App.

2. Description of services

The App supports planning and following multi-day sports-car touring events (stages, stops, hotels, votes, photos, and similar). Much of the content — in particular routes, locations, times, distance/mileage figures, hotels, GPX files, sponsors and links — is entered by organisers or other users. The App is not a navigation system and does not replace one.

3. Free use, no availability guarantee

The App is provided free of charge. There is no entitlement to any particular availability, functionality, or freedom from errors. The Provider may change, restrict, or discontinue features at any time.

4. User obligations

• You are solely responsible for the content you enter and the photos you upload, and you warrant that you hold the necessary rights to do so.
• You will at all times comply with road traffic regulations and all applicable laws while driving. Information provided by the App does not relieve you of your own attention and care.
• You will not post unlawful, offensive, or rights-infringing content.

5. Liability and limitation of liability

5.1 Content is non-binding. All information displayed in the App — in particular routes, locations, times, distance and mileage figures, hotels, GPX files, and external links — is provided for non-binding informational purposes only. The Provider gives no guarantee as to its accuracy, completeness, currency, or fitness for any particular purpose. Use of this information and participation in tours is at your own risk.

5.2 Exclusion of liability. To the extent permitted by law, the Provider is not liable for damages arising from the use or unavailability of the App, or from reliance on its content; this applies in particular to inaccurate route, location, or mileage information, as well as to content originating from other users or third parties.

5.3 Mandatory exceptions. Liability for intent and gross negligence, for injury to life, body, or health, and under mandatory statutory provisions (e.g. product liability law) remains unaffected and is not excluded. In cases of slight negligence, the Provider is liable only for breach of a material contractual obligation and limited to the foreseeable damage typical for this type of contract.

6. Third-party content and external services

External services reachable through the App (e.g. Apple/Google Maps, WhatsApp) are subject to the terms and privacy policies of their respective providers. The Provider assumes no responsibility for their content or availability.

7. Privacy

Information on the processing of personal data can be found in the Privacy Policy.

8. Changes to these terms

The Provider may amend these Terms of Use with effect for the future. The version published in the App or on this page at the relevant time applies.

9. Governing law, severability

These terms are governed by the law of Austria, excluding its conflict-of-law rules; mandatory consumer-protection provisions of the country of your habitual residence remain unaffected. Should any provision be invalid, the validity of the remaining provisions is unaffected.
